The Supreme Court allowed the appeal against the Customs Tribunal's order based on misinterpretation of Para 204(6) of the Import Trade Control Policy. The Court found an error in the Tribunal's assumption that goods were shifted to a new policy appendix and remanded the case for a fresh decision. No costs were awarded.
