2023 (7) TMI 888 - SCH - Insolvency and BankruptcyCondonation of delay of 38 Days in refiling of the Appeal against approval of Resolution plan - it was held by NCLAT that The delay in filing the Appeal is beyond 15 days and the Application itself mentions the delay of 29 days in filing the Appeal. Our jurisdiction is limited only to 15 days under Section 61(2) proviso of the IBC 2016 hence we are unable to condone the delay in filing the Appeal. HELD THAT - There are no good ground and reason to interfere with the impugned judgment and hence the present appeals are dismissed.
The Supreme Court dismissed the appeals as they found no good ground to interfere with the impugned judgment. Pending applications were disposed of. Justices Sanjiv Khanna and Bela M. Trivedi presided over the case.
