2024 (1) TMI 587 - SCH - Insolvency and BankruptcyMaintainability of SLP - applicability of Section 10-A of the Insolvency and Bankruptcy Code 2016 - HELD THAT - Section 10-A of the Insolvency and Bankruptcy Code 2016 (IBC) was applicable. Hence no reason for interference is made out in exercise of jurisdiction under Article 136 of the Constitution of India. The Special Leave Petition is accordingly dismissed.
The Supreme Court dismissed the Special Leave Petition, concurring with the Tribunal that Section 10-A of the Insolvency and Bankruptcy Code, 2016 applied. The petitioner still has the option to pursue recovery through appropriate legal proceedings.
