1999 (5) TMI 39 - HC - Central Excise
The High Court of Calcutta issued a judgment regarding a writ petition challenging a pre-condition of deposit ordered by CEGAT. The Tribunal halved the total claim for deposit, considering the financial aspect and prima facie case. The Tribunal found that different legal persons were controlled by one individual, Sriram Bhuwalka. The Court ordered a deposit of Rs. 11,50,000 within four weeks for compliance with Section 35F to proceed with the appeal. The order and observations are prima facie and do not affect the Tribunal's decision on the appeal's merits.
