2001 (7) TMI 129 - SCH - Central Excise
The Supreme Court allowed the civil appeal, restoring a writ petition to the High Court for consideration on its merits. The appellant can amend the prayer in the writ petition. The appellant agreed to pay excise duty based on actual production, and no coercive action will be taken to recover alleged balance excise duty. No costs were awarded.
