2023 (10) TMI 1477 - HC - IBCIncorrect citation of sections from the Insolvency and Bankruptcy Code (IBC) - HELD THAT - There is a clerical error which has occurred in the Oral Judgment dated 27th September 2023 while mentioning the sections from the definition clause. In this judgment the sections which have been wrongly mentioned are Sections 2(30) and 2(31) of IBC. However the correct provisions are Sections 3(30) and 3(31). It is directed that correct provisions i.e. Sections 3(30) and 3(31) of IBC wherever they are mentioned in the Oral Judgment dated 27th September 2023 be mentioned in place of the aforestated incorrect provisions. The said Oral Judgment stands corrected accordingly.
In the Bombay High Court case presided over by Justices Sunil B. Shukre and Firdosh P. Pooniwalla, a clerical error was identified in the Oral Judgment dated 27th September 2023. The error involved the incorrect citation of sections from the Insolvency and Bankruptcy Code (IBC). Specifically, Sections 2(30) and 2(31) were mistakenly referenced instead of the correct Sections 3(30) and 3(31). The court has ordered that the judgment be amended to reflect the correct provisions, ensuring that Sections 3(30) and 3(31) are accurately cited throughout the document.
