2005 (9) TMI 89 - SCH - CustomsAppellate Tribunal granted liberty to seek clarification from Supreme Court - Held that - Tribunal must decide the Appeal on its own merits. No clarification is required of our Judgment which speaks for itself. If the Tribunal reads the Judgment it will immediately understand what has been held by this Court - Appeal restored to Tribunal. In the meantime the attachment would continue but the diamonds must not be sold.
The Supreme Court granted permission to file a Civil Appeal. The Customs Tribunal in Mumbai disposed of the main Appeal and granted liberty to seek clarification on a previous Judgment. The Supreme Court set aside the disposal of the Appeal and instructed the Tribunal to decide on its own merits within two months. Attachment of diamonds to continue, but not to be sold.
