The High Court of Bombay ruled that ownership of gold and silver is not a criterion for eligibility under the Gold Import Scheme. The petitioner is entitled to discharge as the prosecution does not survive. Bail bond will be cancelled, and seized gold and silver will be returned to the petitioner. (Case Citation: 1994 (3) TMI 217 - BOMBAY HIGH COURT)
