The Appellate Tribunal CEGAT, New Delhi allowed a Misc. Application regarding the admissibility of Modivation glass bottles for aerated waters. The issue was covered by a Board's Circular, so the matter was remanded to the Assistant Collector for re-consideration in light of the Circular and principles of natural justice. The appeal was allowed by way of remand.
