1999 (10) TMI 172 - AT - Central Excise
The case involved a dispute over the classification of goods under different chapter headings. The appellant attempted to change the classification at the appellate stage without providing the respondent an opportunity to contest. The tribunal ruled that a completely new case cannot be made at the appellate stage without following proper procedures, and thus dismissed the appeal.
