1999 (8) TMI 278 - AT - Central Excise
The Appellate Tribunal CEGAT, New Delhi heard a case involving clandestine removal of goods from M/s. Rajasthan Explosives & Chemicals to another company. The tribunal found a violation of natural justice in the case of Shri Ganesh Mathur and decided to remand the case, waiving the pre-deposit of duty and penalties. The adjudicating authority was directed to provide the appellants with a personal hearing and supply copies of relied-upon documents to Shri Ganesh Mathur. The stay petitions were allowed, and the appeals were also allowed by way of demand.
