The Appellate Tribunal CEGAT, Calcutta set aside the confiscation of steel rails imported by the appellants but upheld the confiscation of switch operating mechanism as capital goods. The steel rails were released without redemption fine, while the fine for the switch operating mechanism was upheld. The appeal was disposed of accordingly.
