Summary

The Appellate Tribunal CEGAT, New Delhi, in the case of Ms. Jyoti Balasundaram, allowed the stay petition for waiver of pre-deposit of duty amounting to Rs.13,80,710. The Tribunal remanded the case back to the Commissioner concerned for examining the case afresh under the provisions of sub-section (4) of Section 3A and for determining annual production capacity and redetermining differential duty, if any. The Tribunal dispensed with the pre-deposit of duty and disposed of the stay petition and the appeal accordingly.
