The Appellate Tribunal CEGAT, Mumbai allowed the appeal, remanding the case to the Commissioner for fresh decision due to infirmity in the impugned order regarding the declared value of imported Marble. The penalty of Rs. 15 lakhs was waived during the hearing. The Tribunal cited previous judgments to support the decision.
