The appeal arose from an order in liquidation proceedings of Lahore Bank, Limited. Surjan Singh, a shareholder, died in 1915 or 1916. An application to bring his representatives on record was opposed as time-barred, but the objection was overruled. The court held that no application was necessary as per Section 126 of the Indian Companies Act, and dismissed the appeal with costs.
