The Appellate Tribunal CEGAT, Mumbai heard a case where goods were confiscated under the Customs Act, 1962, but the Commissioner (Appeals) set aside the order. The Revenue appealed without seeking a stay. The importers sought refund, but the Tribunal couldn't issue directions as it would pre-judge the appeal. The Tribunal advised the importers to apply for early disposal.
