The Appellate Tribunal CEGAT, Kolkata reduced the penalty on Md. Basir from Rs. 15,000 to Rs. 1,000 as he was not the smuggler but just a carrier due to poverty. Penalties on Mantu and Luftar were revoked due to lack of corroborating evidence. The appeals were disposed of accordingly.
