Rule 5 - Period of retention of a copy of the order of arrest and the material by the Adjudicating Authority. - PREVENTION OF MONEY-LAUNDERING (THE FORMS AND THE MANNER OF FORWARDING A COPY OF ORDER OF ARREST OF A PERSON ALONG WITH THE MATERIAL TO THE ADJUDICATING AUTHORITY AND ITS PERIOD OF RETENTION) RULES, 2005Extract Period of retention of a copy of the order of arrest and the material by the Adjudicating Authority. 5. The Adjudicating Authority shall retain the copy of order of the arrest and the material for a period of ten years, or, if before the expiry of the said period of ten years,- (i) any proceedings under section 8 of the Act have been commenced, until the disposal of such proceedings; or (ii) where an appeal has been preferred to the Appellate Tribunal under section 26 of the Act, until the disposal of such appeal by the Appellate Tribunal; or (iii) where an appeal has been filed in the High Court under section 42 of the Act, until the disposal of such appeal by the High Court; whichever is later.
