Article 24 - Insertion of new Article 139-A - Constitution (42nd Amendment) Act, 1976Extract Insertion of new Article 139-A . 24. After Article 139 of the Constitution, the following article shall be inserted , namely: Transfer of certain cases. 139-A. (1) If, on an application made by the Attorney-General of India, the Supreme Court is satisfied that cases involving the same or substantially the same questions of law are pending before it and one or more High Courts or before two or more High Courts and that such questions are substantial questions of general importance, the Supreme Court may withdraw the case or cases pending before the High Court or the High Courts and dispose of all the cases itself. (2) The Supreme Court may, if it deems it expedient so to do for the ends of justice, transfer any case, appeal or other proceedings pending before any High Court to any other High Court. . **************** NOTES:- 1. Shall come into force, w.e.f. 1st day of February, 1977 vide G.S.R. 2(E), dated 3-1-1977.
