39. Inspection by third parties (1) The Authority may appoint any person to inspect the books of account, records, documents infrastructures, systems and procedures or affairs of a CMI: Provided that such person so appointed shall have the same powers of an inspecting authority: Provided further that a CMI and its employees shall have the same obligations towards such person, so appointed as they have towards inspecting authority as specified in regulation 38 with respect to such inspection. (2) The Authority shall be entitled to recover expenses, including fees paid to such person, relating to such inspection from the CMI.
