Remand of matter to the Commissioner (Appeals) - Held that - On remand the Commissioner (Appeals) passed an order in favor of the Department. Hence the matter may be dismissed as withdrawn. He has produced an affidavit dated nil March 2011 by the Deputy Commissioner of Customs Legal Section (Air) Air Cargo Complex Chennai in which it is stated that this Civil Miscellaneous application my be permitted to be withdrawn. Appeal dismissed as withdrawn.
