2025 (4) TMI 1021 - SCH - CustomsMonetary amount invlolved in the appeal - Undervaluation of the export goods - challenge to Expert Panel Opinion inasmuch as it does not reveal the source for the market value - it was held by CESTAT that Valuation provisions under the Customs Act apply only for levy and collection of customs duty and not otherwise. - HELD THAT - It is not inclined to issue notice in the present appeals but clarify that the question of law is left open. Appeal dismissed.
The Supreme Court, comprising Chief Justice Sanjiv Khanna and Justices Sanjay Kumar and K. V. Viswanathan, condoned the delay in filing. The Court noted that the total tax amount involved is Rs. 25,00,000/-. Given the quantum of tax, the Court declined to issue notice in the appeals but expressly "clarified that the question of law is left open." The Court further held that if the same question arises again, the Revenue "will be entitled to raise and argue all contentions available to them." Consequently, the appeals were dismissed, and all pending applications were disposed of.
