2009 (11) TMI 341 - SC - Income TaxInvestigation- In the present case appellant is the passenger he comes in India from abroad. He want to purchase a house in Chennai for this purpose it was required that the payment was made by cash. He take the permission of RBI and his banker. When he reached the airport the money was seized by the income tax officers by assuming that it earn from illegal sources. After 2 months, after verifying all the documents they return back the money without interest. Thus the appellant filed an appeal in Andhra Pradesh High Court but it reject it as it has no jurisdiction to entertain it. Now he filed this appeal to Chennai High Court. Held that- any bonafides measures taken in public interest, and to provide public safety or to prevent circulation of black money could not be objected to as inference with personal liberty or freedom of the citizen. The appellant is not entitled to any further relief in the matter. The effort of the Ld. Solicitor General to finds a solution to reduce the hardships of the traveling public without compromising the security/intelligence concerns required to be appreciated.
