Eligibility of ‘Ethylene Oxide Sterilizer’ under Notification No. 21/2002-Cus - Customs - 059/03

Circular No. 59/2003-Cus., dated 16-7-2003 F.No. 528/7/2002-Cus.(TU) Government of India Ministry of Finance (Department of Revenue) Central Board of Excise Customs, New Delhi Subject: Eligibility of 'Ethylene Oxide Sterilizer' under Notification No. 21/2002-Cus. I am directed to refer to the subject mentioned above and to say that a doubt has been raised as to whether the apparatus 'Ethylene Oxide Sterilizer' is eligible for Notification No. 21/2002-Cus., Serial 367 read with list 38 (item 10) which covers 'Sterilizers (high speed/Ethylene)'. It has been stated that the term 'Ethylene Sterilizer' is a shorter version of 'Ethylene Oxide Sterilizer'. 2. The matter has been examined. Ethylene Sterilizer and Ethylene Oxide Sterilizer in technical/trade parlance refer to the same type of Sterilizer which uses Ethylene Oxide as a sterilizing agent. Therefore, it is clarified that Ethylene Oxide Sterilizers are eligible for examination under the said notification. 3. This may be brought to notice of all concerned. 4.
