Clarification in respect of the NOC required from Asstt. Drug Controller, ACC for the Export of Drug-Reg. - DGFT - FACILITY NOTICE 29/2008

Drug Controller, ACC for the Export of Drug-Reg. Attention of all Exporters, CHAs and Members of the Trade is invited to the above subject. Representation has been received from the trade that while filing the S/B with the Customs, at the time of assessment, the officers call for the NOC from the Asstt. Drug Controller stationed at the ACC. Trade contends that as per DGFT Policy Circular 1 (RE-99)/99-2000 dated 15.04.99 , the products listed in Indian Pharmacopoeia, NOC is not required from Asstt. Drug Controller and hence it should be waived. The issue has been examined. DGFT Policy Circular 1 (RE-99)/99-2000 dated 15.04.99 mentions that It is, therefore, been decided that in such cases where a bulk drug is an approved drug i.e. it figures in the India Pharmacopoeia (IP), there is no need of any attestation by the Drug Controller Officers. All approved drugs may not find a mention in the Indian Pharmacopoeia. Therefore, as long as a drug was approved by the offices of Drug Controller General of India, irrespective of the fact whether it was mentioned in the Indian Pharmacopoeia or not, no attestation from Drug Controller Officers stationed at different ports should be insisted in future. Therefore, it is hereby clarified to all concerned that the shipments of the export of drugs would not be required to be sent in regular course to Asstt. Drug Controller, ACC for NOC as long as drugs exported are figuring in Indian Pharmacopoeia or approved by offices of Drug Controller General of India, as the case may be.
