OFFICE OF THE COMMISSIONER OF CUSTOMS (EXPORTS) Air Cargo Complex, Sahar, Andheri (E), Mumbai -99 File No. S / 3 Prev, Admn. - 38 / 2013 ACC Date :10/05/2013 PUBLIC NOTICE No. 15/2013 Attention of all concerned is invited to Ministry of Finance Notification No. 104/94-Cus. dated 16.03.1994, as amended by Notification No. 101/95-Cus. dated 26.05.1995, and Board s Circular No. 31/2005-Cus. dated 25.07.2005. 2. As per the said Notification, containers of durable nature are permitted to be imported without payment of duty on execution of a Bond by the importer binding himself that these containers will be re-exported within a period of six months from the date of their importation. 3. Requests have been received from some Airlines/Authorised representative of Airlines for permission to import, without payment of duty, pallet, containers (ULDs) and temperature controlled cool-containers for movement of Customs cleared imported cargo out of Air Cargo Complex, Sahar, Mumbai, to consignee s facility and return the same to Air Cargo Complex, Sahar, Mumbai, either empty or with export cargo. 4. Therefore, it has been decided that Airlines/Authorised representative of Airlines desirous of importing such containers shall be permitted to import, without payment of duty, temperature controlled cool-containers at Air Cargo Complex, Sahar, Mumbai, subject to following conditions a) The containers so imported shall be re-exported within a period of six months from the date of their importation and the Airline/ Authorised representative of Airlines shall submit within (7) days relevant documents certified by Customs evidencing such re-export. b) The Airline/Authorised representative of Airlines shall execute a Bond for an appropriate amount binding themselves that these containers will be re-exported within a period of six months from the date of their importation and with following details i) The nature of the Bond should be Continuity Bond . ii) The validity period of the Bond shall be for one year which would be extendable to further such period as requested by the person executing the Bond. iii) The Bond amount should cover duty leviable on all the containers estimated to be imported during the corresponding period. 5) The Airline shall submit to the Container Cell, Air Cargo Complex, Sahar, details of all such containers imported and exported on each flight duly certified by Customs IFO/EFO. 6) The Airlines/Authorised representative of Airlines, shall seek permission of Deputy/Assistant Commissioner of Customs/Container Cell, ACC, for moving these containers out of Air Cargo Complex, and shall submit details of such containers and their intended local movement. 7) The Airlines/Authorised representative of Airlines shall maintain separate records and shall submit to the Container Cell, Air Cargo Complex, Sahar, monthly statement in the enclosed proforma by 7th of every month in respect of all such containers imported/exported /pending during the preceding month. 8) The Airlines/Authorised representative of Airlines shall invariably mention Serial Numbers of these Containers in the IGM and EGM of the flights on which they are transported.
