S/6-MISC-135/2009 (X) Shed ACC Date : 28.08.2009 Public Notice No. 25/2009 Subject: - Filing of report with Customs when differences in contents vis-a-vis AWB are noticed during security scanning of export cargo -reg. CHAs, Airlines and Custodians are aware that, after the Customs issue Let Export Order on the basis of procedures in force, the export cargo is subjected to security x-ray scanning by Airlines/Custodians (MIAL and NACIL). 2. The personnel carrying out the scan are trained to distinguish objects and contents, and Air Way Bill (AWB) is also available at the time of scanning. As a result there is all likelihood that such personnel would notice when the scan reveals a detail that does not gel with contents mentioned on the AWB. Such differences when noticed are to be brought to the immediate knowledge of the Customs. 3. However, in absence of a formal procedure for transmitting and recording such information to/by the Customs, it is possible that the details on AWB (of the nature of goods) could be altered and the cargo loaded on aircraft and exported. In such an eventuality goods, not declared in Shipping Bill, would get exported and smuggling would occur. 4. To reduce scope for malpractice in such situations, the precautionary step of introducing a formal reporting and action mechanism is necessary. Henceforth - (a) A Register titled Register for Reporting Difference in Contents Noticed during Security Scanning of Export Cargo after LEO shall be maintained by Customs in the Batch Office (for General Shed) and in the APEDA Shed. Format of said Register is attached. (b) The scanning personnel/Airlines/Custodians (upon noticing that scan reveals a detail that does not gel or tally with contents mentioned on AWB) shall, without loss of time, mandatorily fill the particulars of AWB and discrepancy noticed in the said Register. The personnel shall sign in token of having made the entries. (c) This should be complemented (but not substituted) by verbal information to the concerned Batch/APEDA Shed Customs Superintendent. 5. Based on these inputs further necessary action shall be taken by the concerned Superintendents 6. All concerned are requested to ensure compliance with this mechanism. Non-conformity shall invite appropriate actions under extant law in force.
