Import of Air Conditioners and other Equipment which do not contain ODS gases - Customs - 05/06

Attention of all the Importers, Exporters, CHAs and Members of the Trade is invited to the Policy Circular No. 35(RE-2005)/2004-09 dated 01.12.2005 wherein it has been clarified that the policy of Air Conditioners containing HCFC - 22 only is under review and Air Conditioners which do not contain ODS substances will be allowed to be imported freely both under EPCG scheme and under normal imports. The Director General of Foreign Trade (DGFT), vide his office letter F. No. 01-93/180/1036/AM- 99/PC I(A)) dated 07/22.12.2005, has further clarified that the Policy Circular No. 35 dated 01.12.2005 shall also be applicable to Compressors, Chillers, Water Coolers which do not contain ODS substances. In view of the facts stated as above, the Importers of Air Conditioners/Compressors/Chillers/Water Coolers should declare in the Bills of Entry that these Equipment s do not contain ODS substances, and a certificate from supplier to this effect shall be submitted at the time of Assessment/Examination of the goods (NAJIB SHAH) Commissioner of Customs (Import) JNCH, SHEVA
