The undersigned is directed to refer to Ministry's instructions issued under F.No. 305/8/86-FTT dated 25.7.86 regarding import of deep sea fishing trawlers under 100% EOU Scheme, and to say that under Notification No. 86/84-Cus. dated 19.3.84, spare parts of production machinery imported by the 100% EOUs have been exempted from payment of import duty. In the case of Deep Sea Fishing Trawlers, the Trawlers used for fishing are the only production machinery and, therefore, the spare of such trawlers would qualify for exemption from duty under notification no. 86/84-Cus. dated 19.3.1984. You may accordingly consider regularising the assessment of spare parts of Trawlers, which were cleared provisionally after 19th March, 1984, under notification No. 86/84-Cus. and finalise these assessments.
