Central Excise - Payment of Government dues in instalments instructions - Regarding F. No. 289/10/91-CX. 9 Dated 18-3-1991 Government of India Ministry of Finance (Department of Revenue) Central Board of Excise Customs, New Delhi Subject : Central Excise - Payment of Government dues in instalments instructions - Regarding. I am directed to refer to Instructions contained in F. No. 289/56/85-CX. 9, dated 5-8-1985 under which the powers of the Collectors to allow payment of Government dues in instalments were withdrawn, and to say that the question of empowering Principal Collector of Central Excise to exercise these powers has been under consideration of the Government for some time past. The Government have now decided to delegate to Principal Collectors of Central Excise the power to grant, in individual cases, the facility of payment of Central Excise dues in upto 12 instalments, on merits. The facility will be granted only in deserving cases, taking into account the financial position of the assessee, the long term interest of revenue on the usual terms and conditions with simple interest at 17.5% compounded at the end of each month chargeable from the date of confirmation of the demand. 2. A report of such cases should be sent to the Board every month. 3. Request for payment in more than 12 instalments may be referred to the Board for orders with a clear recommendation giving, inter alia, the financial position of the assessee, his past tax performance etc.
