Transfer of files pertaining to dealers engaged in works contract transactions and transfer of right to use goods to special zone - VAT - Delhi - No. VAT/POLICY-III/2005-2006/1047

ORDER In exercise of the powers conferred under section 68 of the Delhi Value Added Tax Act, 2004 (Act No. 3 of 2005), read with sub section (2) of section 9 of the Central Sales Tax Act, 1956 (74 of 1956), I, R.K. Verma, Commissioner (Value Added Tax), hereby direct that all returns already filed or to be filed by the 517 dealers, mentioned in the enclosed list, under the said Act and the Rules framed thereunder, in respect of the year of implementation of VAT Act, 2004 (i.e. 2005) and onwards, shall be transferred to the Special Zone of the department created for dealing with the cases pertaining to Works Contract and Right to Use Goods and in future the following dealers shall file all the returns in the said Special Zone. The officer(s) concerned deputed in the said Special Zone to handle cases of such dealers as mentioned in the enclosed list shall be responsible to monitor the payment of tax by these dealers and to deal with all proceedings arisen in pursuance to such returns filed or to be filed in future, including all other transactions involving general sale/purchase activities. The present VATOs / AVATOs of the concerned operational units/wards, where these 517 dealers are registered, shall cease their jurisdiction over the corresponding dealers (mentioned in the enclosed list) in relation to all proceedings under the Delhi Valuo Added Tax Act, 2004, the Delhi Sales Tax on Works Contract Act, 1999 (Delhi Act 9 of 1999) and the Delhi Sales Tax on Right to Use Goods Act, 2002 (Delhi Act 13 of 2002). The assessment for the year 2004-2005 will also be undertaken by Special Zone for these 517 cases. (R.K.
