Exemption to specified goods falling within Chapter 28, 29, 84, 85 or 90 - 242/89 - Customs -TariffExtract Exemption to specified goods falling within Chapter 28, 29, 84, 85 or 90 Notification No. 242/89-Cus. Dated 3-10-1989 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts the goods specified in the Table annexed hereto and falling within Chapter 28, 29, 84, 85 or 90 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), when imported into India for the manufacture of laser and laser based instrumentation from — (a) the whole of the duty of customs leviable thereon under the said First Schedule; and (b) the whole of the additional duty leviable thereon under section 3 of the said Customs Tariff Act. subject to the conditions that the importer, at the time of import — (i) produces a certificate from an officer not below the rank of Deputy Secretary to the Government of India in the Department of Atomic Energy to the effect that the said goods (in respect of description, quantity and technical specifications) are required for the production of laser and laser based instrumentation; and (ii) furnishes an undertaking to the Assistant Collector of Customs to the effect that - (a) the said goods, shall be used for the purpose specified above; and (b) he shall pay, on demand, in the event of his failure to comply with (a) above, an amount equal to the difference between the duty leviable on such quantity of the said goods but for the exemption contained herein and that already paid at the time of importation. (i) Laser Rods (a) Neodymium : Yag (b) Neodymium : Glass (c) Ruby (d) Erbium : Yag (e) Ti : A1203 (ii) Helium - Neon Laser Tubes - 2 milliwatts power (iii) Semiconductor visible lasers - 2 milliwatts power (iv) Dielectric coated mirrors for visible, near IR 10.6 micrometer region (v) ZnSe mirrors, ZnSe lenses and ZnSe windows (vi) Gratings for visible and 10.6 micrometer region (vii) Dye cells and laser dyes (viii) Thin film polarisers for visible, near IR region (ix) Electro-optic switches for visible, near IR 10.6 micrometer region (x) (a) Flash lamps (Xenon, Krypton) (b) Arc lamps (Krypton) (xi) Second harmonic generation crystals 2. (i) Energy storage capacitors (ii) Thyratrons (iii) Photodetectors and photomultipliers 3. Metering needle valves and pressure indicators 4. Spectroscopic grade pure gases viz., Xenon, Krypton, Fluorine, Argon 5. Vacuum pumps of capacity upto 20 litres per minute 2. This notification shall be in force upto and inexclusive of the 30th day of September, 1992.
