Maintenance of Register of Attestation Services by the Practising Company Secretaries [Pursuant to clause (2) of Part II of the Second Schedule of the Company Secretaries Act, 1980] - 1001: 1: DR:PCS, - Companies Law

Notification No. 1001: 1: DR:PCS, dated 1-4-2005. Subject:- Maintenance of Register of Attestation Services by the Practising Company Secretaries [Pursuant to clause (2) of Part II of the Second Schedule of the Company Secretaries Act, 1980] In exercise of the powers conferred by Clause (2) of Part II of the Second Schedule to the Company Secretaries Act, 1980 (56 of 1980), the Council of the Institute of Company Secretaries of India hereby specifies that with effect from 1st April, 2005 every Practising Company Secretary (ACS)/Firm of Practising Company Secretaries shall maintain register in the following format regarding attestation services mentioned hereinbelow provided by him/her/it: Sl. No. Name and Registration No. of the Company to which attestation services provided Details of Services Rendered in connection with signing/certification Date of Attestation/Signing of Certificate/Return/Audit Report Signature of the PCS 1 2 3 4 5 2. The Register shall be open for inspection by the authorised representatives of the Institute. 3. For the purposes of this Register, the attestation services shall include : ( i ) Signing of Annual Return pursuant to proviso to sub-section (1) of section 161 of the Companies Act, 1956. ( ii ) Issue of Compliance Certificate pursuant to proviso to sub-section (1) of section 383A of the Companies Act, 1956. ( iii ) Issue of certificate of Securities Transfers in compliance with the Listing Agreement with Stock Exchanges. ( iv ) Audit for the purposes of reconciliation of capital, updation of Register of Members etc. pursuant to Regulation 55A of the SEBI (Depositories and Participants) Regulations, 1996. ( v ) Conduct of Internal Audit of operations of the Deposi tory Participants. ( vi ) Any other service as may be notified by the Council from time to time.
