Ban on export of Edible Oils - 85 (RE-2007)/2004-2009 - Foreign Trade Policy

Superseded vide Notification No. 01/2015-2020 - Dated 06-04-2018 (TO BE PUBLISHED IN THE GAZETTE OF INDIA EXTRAORDINARY PART II SECTION 3, SUB SECTION (ii)) GOVERNMENT OF INDIA MINISTRY OF COMMERCE INDUSTRY DEPARTMENT OF COMMERCE NOTIFICATION NO. 85 (RE-2007)/2004-2009 NEW DELHI, THE 17 th MARCH, 2008 S.O.(E) In exercise of the powers conferred by Section 5 of the Foreign Trade (Development Regulation) Act, 1992 (No.22 of 1992) read with Para 1.3 and Para 2.1 of the Foreign Trade Policy, 2004-2009, the Central Government hereby makes the following amendments to the ITC(HS) Classifications of Export and Import items, 2004-2009 as amended from time to time : With effect from 17.3.2008, the following new entry shall be inserted after entry at Sl. No.67 in Chapter 15 under Schedule 2 of ITC(HS) : - Sl. No. Tariff Item HS Code Unit Item description Export Policy Nature of Restriction 67A Codes pertaining to all edible oils under Chapter 15 of Schedule I Kg. All edible oils under Chapter 15 of Schedule I Prohibited Not permitted to be exported [1] 1.1 Restrictions imposed vide this Notification shall not apply to the following: (i) Export of Castor Oil, (ii) Export of Coconut Oil through Kochi Port, (iii) 'Deemed export' of edible oils to 100% export oriented units with the condition that the final product be non-edible, (iv) Export of Oils produced out of minor forest produce, as per table given below, even if edible : ITC (HS) Code Item Description 15159010 Fixed Vegetable oils viz. Neutralised and Bleached Morwah Oil/fat, Neutralised and Bleached Kokum oil/fat, Neutralised and Bleached Sal oil/ sal fat / Stearine. 15159020 Fixed vegetable oils viz. Dhup oil, Neemseed oil 15159030 Fixed vegetable oils viz. Nigerseed oil. 15159040 Fixed vegetable oils viz. Neutralised and Bleached Mango kernel fat/oil/stearine/olein. 15179010 Sal Fat (Processed or Refined). 15219020 Shellac wax, whether or not coloured. (v) Export of edible oil from Domestic Tariff Area (DTA) to Special Economic Zone (SEZ) to be consumed by the SEZ units for manufacture of processed food products. ] 2. Transitional arrangements allowed under Para 1.5 of the Foreign Trade Policy, 2004-2009, shall, in public interest, not be applicable to the ban imposed above. 3. 2 [ The ban imposed vide this Notification shall be applicable upto 30.09.2011. ] 4. Substituted vide Notification No. 98 (RE-2008) / 2004-2009, dated 17/03/2009 , before it was read as;- The ban imposed vide this Notification shall be applicable for one (1) year from the date of this Notification. Further Substituted vide Notification No. 04/2009-2014, dated 04/09/2009, before it was read as:- The ban imposed vide this Notification shall be applicable for two (2) years from the date of this Notification, i.e. upto 16.3.2010 Further Substituted vide Notification No. 07(RE-2010)/2009-2014, dated 30/09/2010 , before it was read as:- The ban imposed vide this Notification shall be applicable upto 30.09.2010.
