For the purpose of Export, the exported goods can be Sealed and Stuffed either from any factory premises/warehouse by the Central Excise officers or at the Place of Export by the Customs Officers.

You may contact any local CHA  agent on the issue.

TRADE NOTICE : 53 / 2004 Dated : 4.08.2004

Sub:- In house stuffing of containers – Instructions – Reg.

In supersession of all the earlier Instructions / Circulars / Public Notices issued by this office on the above subject, the following instructions are issued for strict compliance by the Exporters and field formations.

(I) All the earlier permissions granted for in house stuffing (excisable / non- excisable) and the

movement of containers for in-house stuffing in respect of all the Exporters are hereby dispensed with immediately.

(II) All the manufacturer-exporters are eligible for self-sealing of packages or containers vide Board’s Circular No. 736/52/2003 cx dated 11.08.2003 (Trade Notice No. 117 / 2003 dated:

14.08.2003). Hence, Manufacturer-Exporters may opt for self-sealing of packages or containers.

(III) Manufacturer-Exporters who are not desiring to opt for self-sealing of Containers and other Exporters may avail the facility of nearest Inland Container Depot (ICD) / Container Freight Station (CFS) for stuffing containers and other customs clearance.

(IV) In exceptional cases, the request for in-house stuffing will be considered on case-to-case basis, if there is any undue hardship in stuffing at ICD/CFS/Gateway Port, by the Jurisdictional Joint Commissioner or Additional Commissioner after obtaining verification report with regard to location, nature of the commodity, justification for such facility and genuineness of the exporters. Exporters desiring to obtain permission for In-house stuffing are requested to submit their request furnishing the information cited above to the Range Superintendent having jurisdiction over the premises from where goods are to be stuffed. The request of the Exporters shall be forwarded by the Jurisdictional DC/AC who shall forward the same alongwith their recommendations to their respective Joint/Additional Commissioner of Central Excise in-charge without any delay.

(V) The Joint Commissioner or Additional Commissioner shall accord permission for In-house stuffing for each financial year after satisfying himself and for the reasons to be recorded in writing.

In case something adverse is noticed against the exporter, the permission granted will be withdrawn.

The contents of the Trade Notice may be brought to the knowledge of all constituent members of Trade Associations / Chambers of Commerce.
