IT Exemption for Mediclaim (u/s 80 D) for parents of spouse

Hi,

I have two Mediclaim Policies as follows:

  • 1st Mediclaim Policy: Myself, My father and My Mother (Annual Premium ₹ 12,712/-)
  • 2nd Mediclaim Policy: My Wife, Father-in-Law and Mother-in-Law (Annual Premium ₹ 12,328/-)

(Note: My Father and my Father-in-Law are Senior Citizens)

u/s 80 D: Limits of tax exemption are as follows:

  • for self, spouse, dependent children + parents = Max - ₹ 15,000/-
  • for senior citizen parents = ₹ 35,000/-

I have two queries:

  1. Can I consider Mediclaim of my Father-in-Law and Mother-in-Law for tax exemption?
  2. As you can see that both policies are combined with senior citizen member, what will be exactly eligible amount for tax exemption?

Whether you have got cleared in the above query. However I give my view. You are not eligible for the medical of your father-in-law and mother-in-law for tax exemption, since explanation to Section 80D(2) defines the term 'family' as spouse and dependent children.
