Import from China , Ecport to Europe

Dear Sirs,

We are manufacturer Exporter located in Gujarat and having 10 crore turnover p.a. . We are importing some spares from China and now the same is asking from Europian country.

Can we do trading import in this case , as we import from China and direct export to Europe , without landing of material in India ? In this case , we save our time and freight both.

But, to save all these thing we do not know about legality like FEMA or Customs.

We usually handle such cases, this kind of movement is called third country movement in logistics, which are done on switch Bill of Lading basis, Against this switch bill of lading and your invoice from India, you will get the Forex to india, which is fully legal, you are not surpassing any regulations in this case.

Now, if, we invoicing to European party then our customs will come in picture ?

Dear Sir,

Please note that in case of Forex coming to India through a third country cargo movement, you only need a document which supports the transaction, Any forwarder or us from India who is involved will give you this Switch Bill of Lading, This is well acceptable by the authorities,

Regarding the duty content in India, when shipment is not coming to India, there would be no duty involvement in India, However the consignment as you suggested is going to Europe so duty will be applicable there.

We have been doing Third country transactions since last 11 years, so we know the knitty gritties of the same.
