The Gujarat High Court set aside the Tribunal's order and remanded the matter for fresh consideration in light of a judgment by the Apex Court. The Tribunal is directed to consider the applicability of proviso to section 11AC and pass a fresh order within three months. The Appeal and Civil Application were disposed of accordingly.
