2019 (7) TMI 2060 - AT - Service TaxMaintainability of appeal - non-prosecution of the case - HELD THAT - On matter being called neither anybody appeared nor is there any adjournment request. It is seen that the matter has been coming up repeatedly on record when the same was being adjourned either at the request of the Advocate or in the interest of justice. The appeals are being listed from October 2018 onwards on various dates. The appellants are not interested in pursuing the appeals. The same are accordingly dismissed for non-prosecution.
The Appellate Tribunal (CESTAT Allahabad) dismissed the appeals for non-prosecution due to the appellant's repeated failure to appear despite multiple adjournments since October 2018. The Tribunal held that "the appellants are not interested in pursuing the appeals," leading to dismissal. No adjournment request was made at the hearing, and the order was pronounced in open court by Hon'ble Mrs. Archana Wadhwa.
