2023 (11) TMI 1374 - AT - Service TaxDismissal of appeals for non-prosecution - HELD THAT - In view of the submissions as made by learned Chartered Accountant and the reasons as explained in the Miscellaneous Applications the Final Orders dated 31 July 2019 dismissing the appeals for non-prosecution are recalled. Registry is directed to restore the appeals to its original number. Accordingly Miscellaneous Applications are allowed.
The Appellate Tribunal (CESTAT Allahabad) in Miscellaneous Applications filed for restoration of appeals dismissed the appeals for non-prosecution by Final Order Nos. 71498-71499 of 2019 dated 31 July 2019. Upon submissions by the appellant's Chartered Accountant and reasons stated in the application, the Tribunal "recalled" the dismissal orders and directed the Registry to restore the appeals to their original numbers. The applications were accordingly allowed.
