The Supreme Court allowed the appeal for enhancement of sentence filed by the Assistant Commissioner of Central Excise. The High Court's decision was partly overturned as it wrongly dismissed the appeal based on technical grounds. The Court directed the High Court to treat the appeal as a revision application and decide the case on its merits.
