1970 (9) TMI 126 - CALCUTTA HIGH COURTExtract: ....... trial court was right in dismissing the plaintiffs' suit. For the reasons stated above, we set aside the judgment and decree of the lower appellate court and restore those of the trial court. The appeal is allowed but in the peculiar facts and circumstances of the case we direct each party to bear his own costs throughout. D. Basu, J. I agree.
