No. S/3-MISC-PRO-13/2018-19 ACC(I) Date: 31.10.2018 PUBLIC NOTICE -85/2018 Sub: Strict compliance of the Electronics and Information Technology Goods (Requirements for Compulsory Registration) Order, 2012 Attention of all Importers, Customs Brokers, Members of the Trade Industry Associations, Customs Officers and others is invited to Electronics and Information Technology Goods (Requirements for Compulsory Registration) Order, 2012 (CRO) which obligates the importer to import 44 types of electronic/IT goods, only if the said goods conform to the standards as stipulated in the said order. 2. Instances have come to the notice that goods not complying to the standards are being imported and cleared in violation of the policy of the government laid down vide above said Electronics and Information Technology Goods (Requirements for Compulsory Registration) Order, 2012 . This leads to free availability of sub-standard products into the country and thereby poses a serious threat to the consumer safety. 3. In this regard, Ministry of Electronics and Information Technology (MeitY) have informed that: (a) All the products notified under CRO must bear the Standard Marks. The guidelines for use of Standard Mark and labeling requirements under BIS can be verified from http://meity.qov.in/writereaddata/files/Circular-Mark Registration.pdf. (b) BIS grants a unique registration no. to the manufacturers for the notified products. The registration no. is unique for a Product, Brand, Model, Manufacturer, Manufacturing location etc. therefore verification shall be done in all these aspects. These details are available on the web portal www.crsbis.in, where the veracity of the BIS registration can be verified. 4. Mobile phones also figure in the above said notified list of products. Given the fact that mobile phones are generally being imported in very large numbers, therefore, it is clarified that: (a) Import of 'GSM Mobile Handsets' without International Mobile Equipment Identity (IMEI) No. or with all Zeroes IMEI is 'Prohibited'. (b) Import of 'CDMA mobile phones' without Electronic Serial Number (ESN)/ Mobile Equipment Identifier (MEID) or with all Zeroes as ESN/MEID is 'Prohibited'. 5. Please refer to updated (Revision 12): June 2018 version of Frequently Asked Questions as available on the website of MeitY (Link: http://meity.gov.in/writereaddata/files/FINAL_FAQs_June%202018.pdf ). It contains Generic Issues in Part-I and Decisions Related to Product Coverage under the Order in Part-II. A copy of the same is Annexed along with this Standing Order. The same should be carefully seen for clarification of any doubts so that clearances are not delayed due to lack of clarity to both trade and Customs Officers. 6. In view of the above, all the officers posted in Assessing Groups as well as Import Shed are directed to ensure the strict compliance of the Electronics and Information Technology Goods (Requirements for Compulsory Registration) Order, 2012 and Import Policy for mobile phones and to ensure that the description of imported goods as declared in the Bill of Entry is covered by BIS Certificate in terms of all parameters because BIS Certificate is linked to manufacturer, location of factory, product and brand. Further, Assessing Groups as well as Import Shed are also directed to ensure that the Importer/Custom Broker has uploaded the BIS Certificate on e- Sanchit to check its veracity, validity etc. The list of electronic/IT goods covered under Electronics and Information Technology Goods (Requirements for Compulsory Registration) Order, 2012 is attached with this Standing Order for reference. 7. In case of any difficulty, the specific issue may be brought to the notice of the Dy./Asst. Commissioner in charge of Group-VA, ACC, Mumbai. 8. Action to be taken in terms of decisions taken in this Public Notice should be considered as Standing Order for the purpose of officers and staff.
