Modification in ICES process with reference to Customs Valuation (Determination of Value of Imported goods) Amendment Rules, 2017 - Customs - PUBLIC NOTICE NO. 243/2017Extract OFFICE OF THE COMMISSIONER OF CUSTOMS, CHENNAI-VIII (GENERAL) CUSTOMS HOUSE, No. 60, RAJAJI SALAI, CHENNAI 600001 F.NO.S.Misc.22/2017-Sys Unit Date: 21.11.2017 PUBLIC NOTICE NO. 243/2017 Sub: Modification in ICES process with reference to Customs Valuation (Determination of Value of Imported goods) Amendment Rules, 2017. ********** Kind attention of Importers/ Customs Brokers is invited to Para 3 (b) of Board s Notification No. 91/2017 - Customs (NT) dated 26th September 2017, wherein, the rule 10 of Customs Valuation (Department of Value of Imported Goods) Rules 2007 is substituted as per Customs Valuation (Department of Value of Imported Goods) Amendment Rules 2017. 2. It is informed that the rule 10, sub-rule (2) of Customs Valuation (Department of Value of Imported Goods) Rules 2007, has been substituted as per Customs Valuation (Department of Value of Imported Goods) Amendment Rules 2017 as follows: For the purposes of sub-section (1) of Section 14 of the Customs Act, 1962 (52 of 1962) and these rules, the value of the imported goods shall be the value of such goods, and shall include - (a) the cost of transport, loading, unloading and handling charges associated with the delivery of imported goods to the place of importation; 3. Further, it is informed that under proviso it is mentioned as Provided that where the cost referred to in clause (a) is not ascertainable, such cost shall be twenty percent of the free on board value of the goods. 4. As per the above proviso under Rule 10 sub rule 2 vide Customs Valuation (Department of Value of Imported Goods) Rules 2007 which has been amended by Customs Valuation (Department of Value of Imported Goods) Amendment Rules 2017, for the nature of contract CI, if the cost referred to freight, loading, unloading and handling charges associated with the delivery of imported goods are not declared individually, the ICES system take the freight charges as 20% of the free on board value of the goods. 5. Hence, all the Importers/ Customs Brokers are requested to declare the rate/ amount for freight, loading, unloading and handling charges also without fail to avoid the calculation by the System as 20% for freight value. 6. If loading/ unloading/ handling charges are Nil , Importers/ Customs Brokers are requested to put O (Zero) for loading, unloading and handling charges individually and not blank. 7.
