Dear Experts, we are getting show caution notice from clrek's personnel mail id on behalf of ETO state gst. No any serial number, no office name given, no any reference of section rule. Just saying differance/mismatch in 3B and 2A. So, unsigned before me within seven days and explain the mismatch.

No online notice, just received the mail from personal mail id.

Please suggest what will be best. How to quesh this notice and go against this.

Also sometime department call to client for gst returns, mismatch, where is office etc as unethical.

Sir,

A simple letter/email is not a notice under sec 73/74. If Deptt. needs some clarifications please extend co-operation so that the unnecessary demand can be prevented. I do not feel any embarrassment caused by such request by the departmental officer.

It is my personal view. Do not take it otherwise

They have you to send an MIS to their higher authority estimating the revenue that department will receive from respective jurisdiction. There are compelled to ask questions informally. Sometime even they request (instead of ordering) the tax payer to cooperate by sending the requested information. They are also to ensure that x amount of revenue should be received from that area and if that does not happen then they send such emails seeking clarity from where they may possibly receive revenue from tax payer.

Sir, they do unethical behavior. corporate with department always welcome. if one person make proper reply then call to other irrelevant documents. but one person not proper reply but give something (you understand) then not a issue.

Call to assessee for visit to department to meet; visit to assessee's place without any valid paper (permission from proper officer); for cancellation to registration, call to visit to department; call to assessee what is type of your business, etc.. what to do.

Dear Querist,

I have deeply gone through both of your aggrieved spontaneous outbursts. You are dragging yourself into avoidable controversy by concentrating on the status of show cause notice. Forget whether it it is a simple notice or simple letter or show cause notice. It is your legal duty to comply with the instructions regarding matching the figures. Figures have to be matched failing which you will invite penalty etc. and penalty is always avoidable. Penalty of ₹ 25000/- is imposable on any person who does not supply information demanded by the department.

Now you feel that you are actually being harassed on one pretext or other by the officers of the department. Most vital point is that you will have to keep your cool and be polite and disciplined while interacting with the concerned. If your records are in order, you must muster courage and meet the higher officers. If you are not attended to properly, meet the highest ranking officer i.e. Commissioner but after crossing through the channels of A.C./D.C., Joint Commissioner, Addl. Commissioner. I hope your problem will be solved amicably.

I again emphasise that you must not leave coolness, politeness, submissiveness and discipline and these cost nothing. I am not blaming you just giving sincere advice to get your work done smoothly and be tension free for ever. Due regard has to be given to the Chair. Govt. is a ruler and we are being ruled over. We will have to accept this legal fact.

My views are impartial and now it is up to you whether you follow my advice or not. I have advised you sincerely in your interest and for your betterment.
