Availing chapter 3 benefit

Dear Sir,

 

Can we avail chapter 3 benefit along with Chapter 4 (DBK) & 5 (EPCG for EO)

Please suggest us.

Yes,

While export under EPCG Licence for export obligation fulfillment you can take drawback, in addition you can also take the benefit of chapter -3 incentives scheme of  FTP 2009-14 if eligible.

Dear Sir,

Thank you very much for your below confirmation.

I have talked to my cha but they says that jnpt custom authority are file sb under this scheme only when we are not avail any other export incentive benefit.

I have told my cha to refer DGFT Policy circular no:-32(RE-2010)/2009-14 dt:-3rd june 2011.

Is it ok sir or any other circular i have to show custom authority.

Dear Pritesh,

 

As I know, there is no need to file seprate SB in customs to avail benefit against chapter 3. You have to file the SB for drawback after that you can take export benefit from DGFT against this shipping bill if you present the documents as per their requirements.

If you are not availing or not able to avail the benefits of Chapter 4/ Chaper 5 benefits, then on free shipping bill you would have to provide the declaration that you would avail the benefits of chapter 3.  The DGFT had issued a notfication in this regard in 2011. 

Further, FMS/FPS/SHIS/SFIs can be availed over and above of the Chapter 4/Chapter 5 benefits.

Kindly check with your CHA.

I will dig out the relevant notification for you.  For this I need some time.
