..... his case is identical to the issue in the case of Hakikat Auto Industries and Somnath Auto Garage, wherein this Bench has directed both the appellants to deposit 50% of the amount. He would also draw our attention to Para-20 of the order in original wherein the proprietor of the appellant had in statement recorded that they had cleared 1792 numbers of Chakado Rickshaws and has received amount in cash and utilized the same in purchases of spare parts and engines. He also submit that on the face of such an admission, there cannot be any doubt as to the clandestine manufacturing and removal of Chakado Rickshaws by the appellant. 6. ..... nal disposal of appeal. 8. At this juncture, prima-facie, we find that appellant has not made out a strong case for complete waiver of pre-deposit of amounts involved. Keeping in mind the view already taken by the Bench in the case of Hakikat Auto Industries and Somnath Auto Garage and facts and circumstances of this particular case, we find that appellant is to be put to some condition to hear and dispose of appeal. We also have taken a note about the financial condition as pleaded by the learned Senior Advocate and keeping that in mind, we direct the appellant to deposit an amount of Rs. 50,00,000/- (Rupees fifty lakhs only) within a period of twelve lakhs from today and report compliance on 04.7.2013 before Deputy Registrar.
