It appears that the decision referred to above has considered the facts and circumstances and case law, referred to by both sides and arrived at the conclusion that the burden lies on the Department to prove that the goods were smuggled, since the goods were not notified under Sec.123 of the Customs Act, 1962. Since this has not been done, the impugned order was set aside therein. In the similar facts and circumstances, following the ratio of the said decision, I accept the plea of the party and in the result, appeal is allowed with consequential relief, if any. 3. In the circumstances, without answering the question of law framed above, we allow the appeal by setting aside the order of the Tribunal.
