Amendment to Notification No. 43/88-C.E. [ Ch. 28] Notification No. 165/88-C.E. Dated 3-5-1988 In exercise of the powers conferred by Sub-rule (1) of Rule 8 of the Central Excise Rules, 1944, the Central Government hereby makes the following amendment in the notification of the Government of India in the Ministry of Finance (Department of Revenue) No. 43/88-Central excises, dated the 1st March, 1988, namely :- In the said notification, in the opening paragraph, - (a) for the words "pesticides falling under Chapter 38 of the said Schedule", the words "goods falling under Sub-heading No. 3808.10 of the said Schedule" shall be substituted; (b) the following proviso shall be inserted at the end, namely :- "Provided that where such use is elsewhere than in the factory of production of the goods of the description specified in the said Annexure, the exemption contained in this notification shall be allowed subject to observance of the procedure set out in Chapter X of the said rules.".
