Another Report was provided by the Regional Fertilizer Control Laboratory, Kalyani when it certified that the sample was Sodium Nitrate. 2.3 Statements under Section 108 of the Customs Act, 1962, were recorded from various persons including the 'G' Card Holder of CHA, caretaker of the godown of M/s R.H. Projects Pvt. Ltd., Director of M/s R.H. Projects Pvt. Ltd., the proprietor of the exporting firm, the appellant herein and several other persons, including the exporter and ultimately due to development of certain facts, statement was also recorded from Shri Basant Kumar Routh, E.O. posted at Haldia Dock and ultimately, Show Cause Notice dat ..... We further take note of the fact that the goods were allowed to be redeemed to the owner of the goods in question, which is under challenge before us by the Revenue and the proprietor of M/s Agrani International, has already been expired, therefore, the appeal filed by the Revenue is also abated. 6. 10. In view of the above discussions, we pass the following orders :
(a) Penalties imposed on Shri Santosh Kumar Jha, M/s Overland Agency, Shri Probhat Kumar Ghosh & Shri Kanulal Sarkar, are dropped;
(b) Penalty imposed on Shri Kailash Khanna is confirmed.
(c) Shri Samir Bhattacharya and Shri Lakshman Kumar Mishra, proprietor of M/s Agrani International, have expired, therefore, their appeals are abated.
(d) As the proprietor of M/s Agrani International has expired, consequently, the appeal filed by the Revenue against M/s Agrani International, gets also abated.
11. In these terms, the appeals are disposed off.
